TERMS AND CONDITIONS 

  • It is understood this Studio/Victory Video and Photography  is the exclusive official photographer retained to perform the photographic and/or video services requested on this Contract.
  • Upon signature, the Studio shall reserve the time and date agreed upon, and will not make other reservations for that time and date. For this reason, unless the Studio is able to fully replace the cancelled reservation, all retainers are non-refundable, even if the date of the wedding is changed or the wedding is cancelled for any reason.
  • Packages can be upgraded but not downgraded. Any additional hours and/or services, besides those stated in the contract, will be billed to the client after the wedding day.
  • No part of any order, including previews, will be delivered until the balance is paid in full before the event.
  • The Studio reserves the right to use photographs, video and/or reproductions for advertising, display, publication or other purposes. Negatives, digital files, and previews remain the exclusive property of this Studio.
  • The Studio may substitute another photographer to take the photographs in the event of Studio/ Photographer’s illness or of scheduling conflicts. In the event of such substitution, Studio warrants that the photographer taking the photographs or video shall be a competent professional.
  • If the Studio/Photographer cannot perform this Contract due to an accident or other casualty, strike, act of God, or other cause beyond the control of the parties, or due to Photographer’s illness or emergency, then the Photographer shall return the deposit or money received to the Client but shall have no further liability with respect to the Contract. This limitation of liability shall also apply in the event that photographic materials are damaged in processing, lost through camera or other media malfunction, lost in the mail, theft or otherwise lost or damaged without fault on the part of the Photographer. In the event the Studio/Photographer fails to perform for any other reason, the Studio/Photographer shall not be liable for any amount in excess of all monies paid.
  • The client agrees to stay in communication with Victory Video and Photography especially within a few days before the event to advise of any changes.
  • The charges in this Contract are based on the Studio Standard Price List. This price list is adjusted periodically and future orders shall be charged at the prices in effect at the time when the order is placed.
  • NOTICE OF COPYRIGHT: It is ILLEGAL to copy or reproduce these photographs or videos elsewhere without Studio’s permission, and violators of this Federal Law will be subject to its civil and criminal penalties.

 

  • EDITING OF PICTURES OR VIDEO
  • All editing decisions by studio are final, unless there’s a special request from client.  Any re-edits other than technical error will incur a re-edit fee. You are booking with Victory Video and Photography because you like the shooting and editing techniques shown on our website, social media, or prints. Please let the studio know, before the event, if you have a specific request on what or how you would like us to shoot/edit your pictures or videos, as well as, a specific moment during the event that you would like to make sure is added to the final edited version of your video/pictures. We spend a lot of hours working on your project, before, during and after your event and our prices are set according to that,.  Any extra editing time other than technical mistakes from our side, must be charged according to the editing time that it takes to fix the issue.  The charge will be $50 per extra hour of editing time. You have 15 days after you receive your videos or pictures to report any problems. After that, all original files must be deleted from our hard drive’s space for new upcoming events. Converting some of you pictures from color to Black and White or sepia is free of charge.

 

  • PHOTO SESSION AS ENGAGEMENT, BRIDAL, HEADSHOTS OR SENIOR PORTRAITS
  • If an illness or situation prevents a photo session from taking place, a client may reschedule their session at least 24 hours prior to their shoot without penalty. Should a client fail to give 24 hours notice, or decide to completely cancel the shoot, the payment received is forfeited and will not be refunded. Photographer reserves the right to reschedule due to illness, weather, equipment malfunction, or other circumstances beyond their control.Re-shoots are determined at the discretion of the photographer. Re-shoots will not be given for poor choices of clothing, make-up, hair or weather related issues, or by not following the recommendations of the photographer.Late Arrivals. Any Client that is late arriving to the session will have the amount of time late deducted from the time allotted for the session, up to 90 minutes. This may also result in a reduction of the number of proofs and edited images. If shooting on location and client is more than 15 minutes late the session will be canceled and the retainer will be forfeited. In this case, the client must reschedule another appointment and pay the session fee again.  Please understand that when we scheduled a time for a session, we can’t schedule anything else for that specific time and date.  We have to leave our office, drive to the location, and be there at least 15 minutes before the scheduled time to set up our equipment so as to start on time.  We believe this shows respect for our clients and consideration of their time.ALBUMS. You have 30 days after you receive your on-line gallery of pictures to select your favorite ones to be included into your album(s). Please let us know if you need more time. Please make sure you select the correct pictures, we can not reprint albums once they are printed. All album design decisions by the studio are final, unless there’s a special request from the client before we send the album off to be printed.
  • RETURN POLICY
  • Our goal at Victory Video and Photography  is your complete satisfaction with your purchase. You have 15 days after you receive your photos or videos to request a re-edit or exchange of your photos or video. In the case of camera failure, inclement weather, or any unforeseen incident that prevents Victory from shooting on a scheduled date, the client will get a full refund of the deposit or payment when applicable. No refund will be given under any circumstances if you fail to attend the activity on the day and at the time listed when the booking was made, or if you decide to cancel or reschedule your event. You may reschedule your event with us  if we have that particular date available, at no extra charge. Please understand that when you book with us, we can no longer offer the same date to anybody else.Due to the nature of digital photography and the fact that all photographs may be viewed by the client on an on-line gallery prior to purchase, once orders have been sent, Victory Video and Photography  has a strict NO REFUND POLICY. Once a transaction has been completed, it is then considered non-refundable. If a buyer has selected and purchased an incorrect photo, he/she must notify Victory Photography.  Refunds will NOT be given due to not liking a photo or video. If the Studio mistakenly sends an incorrect photo to the buyer, as documented on the invoice, Victory will send the correct photo to the buyer free of charge.
